Terms and Conditions

The following Terms and Conditions apply to all products and services provided by Move Design & Marketing (hereinafter referred to as Move Design) and in the event of any dispute are governed by the laws of England.

All work is carried out by Move Design on the understanding that the client has agreed to our terms and conditions.

Copyright is retained by Move Design on all design work including words, pictures, ideas, visuals and illustrations unless specifically released in writing and after all costs have been settled.

If a choice of designs is presented and one is chosen for your project, only that solution is deemed to be given by us as fulfilling the contract. All other designs remain the property of Move Design, unless specifically agreed in writing.

Acceptance of Projects

At the time of proposal, Move Design will provide the customer with a written estimate or quotation by email.

A copy of the written estimate or quotation is to be signed and dated by the customer to indicate acceptance and should be returned to Move Design.

Alternatively, the client may send an email acknowledging acceptance of the quotation, or purchase order in reply to the estimate or quotation which binds the client to accept our terms and conditions.

For the avoidance of doubt, the Move Design Terms & Conditions are what govern the job, not any conditions on the customer’s purchase order.

Design Charges

 Charges for design services to be provided by Move Design will be set out in the written estimate or quotation that is provided to the customer. At the time of the customer’s signed acceptance of this estimate or quotation, indicating acceptance of the Terms & Conditions, a non-refundable payment of 50% of the quoted fee will become immediately due for any projects over £500.

Unless agreed otherwise with the Client, all projects over £500 require an advance payment of a minimum of 50% of the project quotation total before the work commences or is supplied to the Client for review. The remaining 50% of the project quotation total will be due upon completion of the work prior to the release of materials.

Source Files

Proofs will be supplied by Move Design as PDFs or as bitmap graphics as outlined in the scope of work or estimate. Files that are required for Print will be supplied as high-resolution PDFs once the final payment has been made. 

Payment for design work does not include the release of our design source files, copyright, stock images or fonts. If the client requires these files, they will be subject to a ‘buy-out’ charge.

Other Service Charges

 Charges for any additional services requested during the project that are over and above the estimated time or out of scope, will become fully payable (100% of the quoted amount) at the time of estimate or quotation acceptance.


Before final designs or files are released to the client. Move Design will provide the client with a Sign Off Form or a proof email, along with an invoice.

At this time, the full amount due for projects under £500 or the remaining 50% for projects over £500 will become payable and the client must return the Sign off form or an email outlining they sign off the project to Move Design.

If the client has any questions regarding the Invoice, they must submit an email with their queries within 14 days of the invoice date.

Accounts which remain outstanding for 30 days after the date of invoice, will incur a late payment interest charge at the Bank of England Base Rate plus 8% on the outstanding amount from the date due until the date of payment.

Move Design does not accept payments made by cheque.

Any work produced by Move Design on behalf of the client will not be released until payment has been received unless previously agreed in writing.

Copyrights and Trademarks

The client declares that it holds the copyright, licence or trademark permissions for any images, text or other files that it supplies for any work that Move design produces on the client’s behalf.

Any copyright, licence or trademark ownership and or permission will remain with the client or rightful owner.

Any artwork, images, or text supplied and/or designed by Move Design on behalf of the customer, will remain the property of Move Design and/or its suppliers unless otherwise agreed in writing.

After payment has been received for the project created for the client by Move design, a licence for the use of the material is granted solely for the purpose outlined in the estimate or scope of work. Move Design will still hold the copyright unless agreed in writing.

If the client wishes to use any material created by Move Design outside the original scope of work. They must gain written consent from Move Design. An additional charge may be applied for the extra usage.

By supplying images, text, or any other data to Move Design, the customer grants Move Design permission to use this material freely in the pursuit of the design.

The customer agrees to fully indemnify and hold Move Design free from harm in any and all claims resulting from the customer not having obtained all the required copyright, and/or any other necessary permissions.


The number of rounds of corrections will be allocated in the project estimate provided by Move Design. Once the client exceeds the number of rounds of corrections, additional charges will be applied for further amendments.

Any changes Move Deems to be outside the estimated work, will be liable to a separate charge.

After the final designs are supplied to the client, the client agrees to hold full responsibility for any changes made by the client or any third party.


Any design, copywriting, drawing, idea or code created for the customer by Move Design, or any of its contractors, is licensed for use by the client on a one-time only basis and may not be modified, re-used, or re-distributed in any way or form without the express written consent of Move Design and any of its relevant sub-contractors.

All design work – where there is a risk that another party make a claim, should be registered by the client with the appropriate authorities prior to publishing or first use or searches and legal advice sought as to its use.

Move Design will not be held responsible for any and all damages resulting from such claims.

Move Design is not responsible for any loss, or consequential loss, non-delivery of products or services, of whatever cause. The customer agrees not to hold Move Design responsible for any such loss or damage.

Any claim against Move Design shall be limited to the relevant fee(s) paid by the customer.

Supplying Text and Images

The client agrees to supply data in a suitable format which Move Design defines.

Text must be supplied in one of the following: Microsoft Word document, email, PDF, plain text file. Move design does not accept copy that has been scanned, handwritten text or text embedded within an image.

Images must be supplied in a digital format via email, Wetransfer, FTP, Google Drive or another cloud folder. Move Design will not accept images that are scanned or provided in a physical format. The client agrees to provide Move Design with images of suitable quality that do not need any image processing. An additional cost may be applied for any images that require editing.

The client holds full responsibility for the quality of the images that they Provide to Move Design for both digital and printed materials. The client accepts full liability for any images they provide and deem to be poor quality after the final material has been printed.

Move Design holds the right to charge for additional expenses such as image and photography searches, image processing, image conversion and colour correction.

Duration of Project

Any timeframe for the completion of a project given by Move Design is considered to be an estimation. Move Design cannot be held responsible if the project over-runs, whatever the cause.

Completion of Work

Once the client has provided a written sign-off for the project, by either signing and returning the Sign Off form or by confirming the sign-off in an email. Move Design will accept this as project completion. Any additional work or time spent by Move design obtaining print quotes, printing, production, digital uploads or publishing will be subject to a separate charge.


The client allows for the following credit to be placed on any website that Move Design creates along with a link back to Move Design’s own website (credit: Made By Move Design).

The client grants Move Design permission to post any work produced on behalf of the client on Move Design’s own website and social media channels to promote Move Design’s services and portfolio.

Rights of Refusal

Any text, images or other forms of data that Move Design deems to be offensive, obscene, immoral or illegal will not be included in any designs that Move Design produces.

The client agrees to all rules and regulations outlined by all relevant advertising standards and authorities. The Client accepts full liability for any rules or regulations broken.

Project Cancellation

If the client wants to cancel a project, they can do so initial by telephone or email. Move design will need a formal cancellation in writing which has been signed and dated by the client, This can either be emailed to Move design or sent to the company’s postal address.

The Client will be invoiced for all work completed over and above the non-refundable deposit where applicable.

The final payment must be paid within 30 days.


 An account shall be considered default if it remains unpaid for 30 days from the date of invoice. Move Design shall be entitled to remove Move Design’s and/or the customer’s material from any and all computer systems until the amount due has been fully paid. This includes any and all unpaid monies due for services, including, but not limited to, hosting, domain registration, search engine submission, design and maintenance, sub-contractors, printers, photographers and libraries.

Removal of such materials does not relieve the customer of its obligation to pay the due amount.

Customers whose accounts become default agree to pay all Move Design’s reasonable legal and accounting expenses and third party collection agency fees in the enforcement of the debt and these Terms and Conditions.

Email Contents

The contents of emails and attachments sent by Move Design are confidential to the ordinary user of the email address to which it is addressed and may be covered by legal professional privilege. If you are not the intended recipient, please do not use, disclose, forward or copy the contents. Any views or opinions expressed are solely those of the author and do not necessarily represent those of Complete. Please contact the sender immediately and then delete it. Unauthorised use, distribution or publication of this communication is prohibited.

Move Design cannot accept any liability for any loss or damage sustained as a result of software viruses. It is the client’s responsibility to carry out such virus checks as are necessary before opening any attachment that may accompany email communications.


Move Design makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. Move Design will not be held responsible for any and all damages resulting from products and/or services it supplies. Move Design is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold Move Design responsible for any such loss or damage. Any claim against Move Design shall be limited to the relevant fee(s) paid by the customer.

Move Design reserves the right to use the services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their Terms and Conditions. Move Design will not knowingly perform any actions to contravene these and the client also agrees to be so bound.

Move Design and its clients agree to comply with Printers Terms and Conditions which include disclaimers for non-completion on time and the flexibility to supply quantities within 10% of the total ordered. Move Design recommends that if an exact quantity is required, then 10% extra is added to the quantity and extra time made available should the job be delayed.


These Terms and Conditions supersede any previous Terms and Conditions distributed in any form. Move Design reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice.

Acceptance of Terms and Conditions and Quotation

The placement of an order for design and/or any other services offered by Move Design, by email, verbally or in writing, is deemed to be acceptance of these terms and conditions, which are freely available at www.movedesign.co.uk

An estimate validated by the customer’s signature on the estimate or quotation form, or by email, constitutes acceptance of the estimate or quotation and agreement to comply fully with all the Terms and Conditions and forms a Contract for Business between the signatory and Move Design.
